Terms of Service

These terms govern your use of Everyday Reel, operated by EveryDay Real Marketing LLC (in formation) (“we”, “us”). By applying or creating an account you agree to them.

These terms are not the agreement that governs paid work. If we hire you, you will sign a separate Creator Agreement and a statement of work for each project. Those documents control rates, deliverables, licensing and payment. Where they conflict with these terms, they win.

1. Who can apply

• You must be at least 18 years old.
• You must be legally entitled to work as an independent contractor.
• The information you give us must be accurate — particularly your age, location, rate and the ownership of the work you show us.

2. Applying does not guarantee work

We review every application, but we are under no obligation to offer you a brief. Nothing in these terms creates an employment relationship, a partnership, or any exclusivity in either direction.

3. Your account

Keep your login details secure and let us know promptly if you think someone else has access. You are responsible for what happens under your account.

4. Your content

You keep ownership of everything you create. Portfolio material you upload to your profile is used only to assess and present you for work.

Rights in commissioned work are granted through the statement of work you sign for that project — typically a licence to run the video as paid advertising for 6 months, on named platforms and in named territories. You will always see those terms before you agree to film.

You confirm that work you submit to us:

• is yours, or you have the rights to license it to us;
• does not include music, footage, trademarks or a person’s likeness that you are not entitled to use commercially;
• does not infringe anyone’s rights or break the law.

5. Advertising claims

Content you produce for us runs as paid advertising and is subject to platform policies and advertising law. Each brief includes restrictions — typically prohibiting exaggerated health, income or results claims. You agree to follow the restrictions in the brief. We may reject or require changes to any content that does not comply, and non-compliance is not a revision round.

6. Product and app access

Where a brief requires you to use a client’s app or product, we provide access at no cost to you. That access is for producing the commissioned work, is personal to you, and may be time-limited or revoked after delivery. You will never be asked to pay for a client’s product out of pocket.

7. Payment

Rates, revision limits and turnaround are set in each statement of work. Payment is due once your deliverable is approved. We generate the invoice on your behalf, so you do not need to raise one.

You are an independent contractor and are responsible for your own taxes. We do not withhold tax on your behalf unless required by law.

8. Revisions and cancellation

Each brief includes up to 1 rounds of revisions. Revision notes will be specific. If we cancel a project after you have accepted a brief and started work, we will agree a fair kill fee with you.

9. Acceptable use

• Do not misrepresent your identity, age, location or experience.
• Do not submit work made by someone else as your own.
• Do not contact our clients directly to circumvent us during an engagement.
• Do not attempt to disrupt, scrape or gain unauthorised access to the platform.

We may suspend or close accounts that breach these terms.

10. For clients

Where you engage us as a client, a separate services agreement governs scope, fees, deliverables and the rights you receive. Content licences we pass to you are limited to what the underlying creator granted — including the licence duration — and you agree not to run content beyond its expiry or outside its licensed scope.

11. Liability

We provide the platform “as is”. To the extent permitted by law, our total liability arising from these terms is limited to the amounts paid or payable to you in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.

12. Changes and termination

We may update these terms and will notify registered users of material changes. You may close your account at any time; obligations under signed statements of work, including granted licences, survive.

13. Governing law

These terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa have exclusive jurisdiction.

Nothing in this clause deprives you of the protection of any mandatory consumer law of your country of residence.
